Hon’ble HC held that advocate of the petitioner is allowed to be present during Section 70 summon interrogation at a distance beyond hearing range but within visible distance. Further, advocate must be prepared to be present whenever the petitioners are called upon to attend such interrogation.
Similar judgment was given by Hon’ble MP High Court in the matter of Subhash Joshi vs. DGGI wherein it was held that presence of advocate in case of search and seizure shall not be allowed.
