No demand pending investigation proceedings

Telangana High Court held that advisory letters issued by department for payment of tax, interest and penalty under Section 74(5) of the CGST Act are void.

Demand can only be raised after issuance of notice under section 74(1) of CGST Act and consequent adjudication.
