Volvo-Eicher Commercial Vehicles Ltd. – AAAR (Kar)

Appellant is distributor of branded trucks on principal to principal basis and performs sales support activities w.r.t. repair & servicing of Volvo vehicles for Indian customers during the warranty period, reimbursements for which is made by the foreign group company.

Question before AAAR was whether the service recipient is foreign group company or customer.

AAAR held that service recipient is foreign group company i.e. Volvo Sweden and not customer, as the appellant performs repairs at the behest of the foreign group company and not that of the customer.
